Discretionary Bonus. Following the end of each calendar year, and subject to the approval of the Board (or a committee thereof), you will be eligible for a discretionary retention and performance bonus, targeted at forty percent (40%) of your gross base salary for the applicable calendar year, based on your individual performance and the Company's performance during the Steven Jungles Letter Agreement applicable calendar year, as determined by the Company in its sole discretion (the "Discretionary Bonus"). Discretionary Bonus. Following the end of each fiscal year and subject to the approval of the Company's Board of Directors or a committee of the Board of Directors (the "Board"), you may be eligible for a retention and performance bonus, based on your performance and the Company's performance during the applicable fiscal year, as determined by the Company in its sole discretion. Discretionary Bonus. The Employee shall participate in an equitable manner with all other senior management employees of the Company in discretionary bonuses that the Board may award from time to time to the Company's senior management employees. No other compensation provided for in this Agreement shall be deemed a substitute for the Employee's right to participate in such discretionary bonuses.

Discretionary Bonus. The Employer may consider and approve in its sole discretion a performance-based annual discretionary bonus for Executive of up to one hundred percent (100%) of Executive's Base Salary. The Employer hereby approves, to the extent Executive remains employed by Employer, an annual mandatory bonus for Executive of twenty percent (20%) of Executive's Base Salary.
