The parties hereto acknowledge and agree that, for all purposes of this Agreement, the Underwriter's Information consists solely of the following information in the General Disclosure Package, the Prospectus and in the Registration Statement: the concession figure appearing in the fourth paragraph in the section entitled "Underwriting (Conflicts of Interest)" and the information contained in the first and second paragraphs relating to stabilization transactions under the section entitled "Underw...riting (Conflicts of Interest)– Price Stabilization; Short Positions." 16. Partial Unenforceability.
